VIRBAC CORPORATION PRIVACY POLICY

We respect your privacy and understand the importance of privacy to our customers.

This Privacy Policy describes the information Virbac Corporation and iVet.com (together, “Virbac”, “we”, or “us”) collect, how we use that information, how we protect it, and the choices you may make about it to assist you in exercising privacy rights available to you by law.

1. SCOPE AND EFFECTIVE DATE

This Privacy Policy applies to Personal Information handled or otherwise processed by us in our business, including on our websites, mobile applications, and other online or offline offerings provided by Virbac (collectively, the “Services“), and applies to you whether you are accessing the Services for business purposes or if you are using our Services or visiting our website(s) in your personal capacity.

This Privacy Policy does not apply to any third-party websites, services, or applications even if they are accessible through our Services. You should refer to those third-party providers or applications for their applicable terms related to use of your information. For new users, this Privacy Policy is effective upon posting. For existing users, this Privacy Policy will go into effect automatically on the Effective Date listed above. By continuing to use our Services, you are agreeing to this Privacy Policy.

After you read this Privacy Policy, please read our Terms of Sale. This Privacy Policy and our Terms of Sale work together. If any terms in this Privacy Policy conflict with the Terms of Sale, the Terms of Sale will control.

2. PERSONAL INFORMATION COLLECTED

The information collected from you depends on the type of account you set up, and/or the Services you use. We (or a third-party) may collect the following types of information:

  • Personal Information. If you create an account, we may collect information via forms that could directly or indirectly be used to identify you. The exact information we need to collect will depend on the purpose of the form used to collect that information. This information could include details such as your name, email address, mailing address, login credentials, an online identifier, phone number, and any other information collected from or about you (“Personal Information”).
  • Financial information. In connection with a financial transaction via the Services, third-party payment service providers may collect your credit or debit card information, or other financial and payment information. We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information.   • Your communications with us. We collect Personal Information from you when you request information about our Services, request customer or technical support, including messages you submit through support conversations, apply for a job, or otherwise communicate with us, including your full name, email address, phone number, or mailing address. We may also contact you to participate in surveys. If you decide to participate, you may be asked to provide information which may include Personal Information.

In addition to the information that you provide us, we may also automatically collect Personal Information when you use our services such as:

  • Automatic data collection. We, as well as third parties that provide content, advertising, or other functionality on the Services, may collect information automatically when you use the Services. This information may include your Internet protocol (IP) address, user settings, media access control address (MAC address), cookie identifiers, mobile carrier, mobile advertising identifier, and other unique identifiers, details about your browser, operating system or device, location information, Internet service provider, pages that you visit before, during, and after using the Services, information about the links you click, and other information about how you use the Services (collectively, “Log File Information”). We may also collect similar information from emails sent to you which then help us track which emails are opened and which links are clicked by recipients. Information we collect may be associated with accounts and other devices.
  • Cookies, pixel tags/web beacons, analytics information, and interest-based advertising technologies. We, as well as third parties that provide content, advertising, or other functionality as part of the Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies“) to automatically collect information from your devices through the Services. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow us and our partners to record certain pieces of information whenever you visit or interact with our Services.       • Providing access to areas, functionalities, and features of our Services.
      • Provide you with promotions for use of the Services.
      • Answering requests for customer or technical support.
      • Communicating with you about your account, activities on our Services, and policy changes.
      • Processing applications for goods or services and completing requested transactions.
      • Providing you the means to perform activities or transact with third party goods or services providers.
  • Administrative Purposes
    • We use your information for various administrative purposes, such as:
      • Pursuing our legitimate interests such as research and development, network and information security, and fraud prevention.

    • We also use your information for other purposes as requested by you or as permitted by applicable law.
      • Consent. We may use Personal Information for other purposes that are clearly disclosed to you at the time you provide Personal Information or with your consent.
      • Use de-identified and aggregated information. We may use Personal Information and other data about you to create de-identified and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our Services, or other analyses we create.

4. DISCLOSING YOUR PERSONAL INFORMATION TO THIRD PARTIES

In addition to our internal use of information as described above, we may disclose your Personal Information to third parties for a variety of business purposes such as:

  • Contractors. We may disclose information to contractors, financial institutions, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential. This includes service providers that provide us with IT support, hosting, payment processing, customer service, and related services.

  • Acquiring Parties. If we sell all or substantially all of our assets, or are otherwise acquired, your Personal Information may be transferred to a third party. We may also transfer or assign Personal Information to a third party in the event of some other change of control (such as the result of a bankruptcy proceeding).

 5. YOUR PRIVACY CHOICES AND RIGHTS

We provide you with the following privacy choices regarding your Personal Information as required by applicable law and which are described below.

  • Cookies and interest-based advertising. You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. If you adjust your preferences, our Services may not work properly. Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt-out of personalized advertisements on some mobile applications by following the instructions for those mobile device providers.
  • General. You have certain choices about your Personal Information. Where you have consented to the processing of your Personal Information, you may withdraw that consent at any time and prevent further processing by contacting us as described below or you may remove yourself from receipt of further newsletters, surveys, marketing materials, or other information via email by clicking on the conspicuous “Unsubscribe” link located at the bottom of any email we send you. Even if you opt out, we may still collect and use non-Personal Information regarding your activities on our Services and for other legal purposes as described above.

To the extent required by applicable law, you may have the right to:

  • Access to/port information about you, including: (i) confirming whether we are processing your Personal Information; (ii) obtaining access to or a copy of your Personal Information in a structured, commonly used, and machine readable format; and (iii) receiving an electronic copy of Personal Information that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine readable format (the “right of data portability”).
  • Request correction of your Personal Information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your Personal Information, or we may refer you to the controller of your Personal Information who is able to make the correction.
  • Request deletion of your Personal Information, subject to certain exceptions prescribed by law.
  • Request restriction of or object to processing of your Personal Information.
  • Withdraw your consent to our processing of your Personal Information.

6. DATA RETENTION

We store the Personal Information we collect as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable 5 laws. The Personal Information collected at the request of third-parties is generally returned to those third-parties and we do not retain that Personal Information except in those circumstances as listed in this Section 6.

7. SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. We use commercially reasonable safeguards, such as industry-standard encryption technology, to help keep the Personal Information collected through the Services secure. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We have taken appropriate safeguards to require that your Personal Information will remain protected and require our third-party service providers and partners to have appropriate safeguards as well. To the fullest extent permitted by applicable law, we do not accept liability for unintentional disclosure or unauthorized access.

By using the Services or providing Personal Information to us, you agree that we may communicate with you electronically about security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system's breach, we may attempt to notify you electronically by posting a notice on the Services, by mail, or by sending an e-mail to you.

8. CALIFORNIA AND VIRGINIA RESIDENTS

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (together, the “CCPA”), applies solely to individuals who are residents of the State of California. The Virginia Consumer Data Protection Act (“VCDPA”) applies solely to individuals who are residents of the State of Virginia. Those laws provide California and Virginia residents with specific rights regarding their Personal Information.

The rights under the VCDPA are substantial similar, but you should consult the Virginia Attorney General resources to learn more about your rights under the VCDPA.
